Boardwalk Realty General Terms and Conditions

Standard Season minimums (exceptions may apply to individual properties):

Summer: 7-night minimum rental from Saturday to Saturday.

Spring, Fall and Winter: 3-night minimum rental.

Peak Spring break, Fall break and Winter holiday weeks in some properties may require a 7-night minimum rental from Saturday to Saturday.

Due to association rules or other requirements 7-night minimum rentals are required throughout the year in some properties.

Snowbird monthly rentals are available in some properties. Properties may not participate in the program for all months of the Snowbird season (October thru March), available months will vary and are subject to change. Snowbird rentals are available for full calendar months only with arrival on the first day of the month and departure on the last day of the month. Guests inquiring about Snowbird rentals should contact the Boardwalk Realty office at 877-861-3992.

Tentative reservations may be made in advance for the following year in person or by phone. Advance reservations are subject to availability, fee and rate changes. Tentative reservations cannot be taken on peak season Saturdays, please contact Boardwalk Realty during week-day business hours.

All reservations are subject to Boardwalk Realty and Property Owner approval. Online rates are subject to change without notice. State, County and Town lodging tax rates are subject to change without notice.

All Boardwalk Realty rental properties are privately owned and are managed by Boardwalk Realty Inc. It is your responsibility to carefully check your rental confirmation and notify Boardwalk of any error.

The number of Guests shall not exceed, at any time, the advertised occupancy limit for the property, this includes the use of the property’s outdoor features such as pools, decks and boat docks.

Reserving Guest is responsible for any guests that use the property during the term of this agreement. If the property is used, in any way, by more than the advertised occupancy limit, Guests and all others may be required to immediately leave the premises and Reserving Guest is subject to additional charges, up to and including eviction and loss of rent.

Occupancy of Boardwalk Realty properties is intended for family groups and responsible adults only. Reserving Guest must be a responsible adult at least 25 years of age or older, must be present at check-in and in occupancy throughout the duration of the reservation. Guests must furnish legal ID with valid age upon request.

Social gatherings such as: Weddings, receptions, vacationing student groups, fraternities, sororities, graduation parties or house parties ARE NOT PERMITTED and are subject to immediate eviction and loss of rent. Reservations made under false pretenses are subject to eviction and loss for rent.

Guest agrees to follow all local, state and federal laws, posted homeowner association rules, and Boardwalk Realty policies for the area in which Guest will be staying.

Noise Ordinance: Guests agree to be respectful of neighboring residents and comply with the Town of Dauphin Island Noise Ordinance by respecting dark to dawn quiet hours.

Occupancy shall not be such as to disturb or offend the occupants of neighboring houses, and the Guest's presence in neighboring yards, docks, pools, walkways, or decks will be considered trespassing.

Boardwalk Realty reserves the right to refuse rental or discontinue occupancy if, in our judgment, Guest's occupancy of the unit is detrimental to the Property or in violation of local ordinances or Boardwalk Realty rental policies. Boardwalk Realty reserves the right to enter the premises at any time for inspection or maintenance.

Visa, MasterCard, Discover, American Express, E-check, and personal checks are accepted.

At Booking:Payment equal to Twenty-five (25%) of your rental in addition to the non-refundable $55 administrative fee, optional *$70 Vacation Rental Damage Protection coverage, and cost of Travel Insurance.

60 Days Prior to Arrival:Fifty (50%) of the rental is due.

30 Days Prior to Arrival:The remaining balance is due.

Guests with an initial booking made less than 60 days prior to arrival will pay 75% at booking in addition to the non-refundable $55 administrative fee, optional *$70 Vacation Rental Damage Protection coverage and cost of any Travel Insurance. Guests with an initial booking made less than 30 days prior to arrival will pay the full rental balance at booking.

*If you choose not to purchase the optional $70 Vacation Rental Damage Protection, contact Boardwalk Realty to add a refundable $3,000 damage deposit that will need to be mailed to Boardwalk Realty by check to secure your reservation.

In addition to the unit rent and optional Vacation Rental Damage Protection Plan and recommended CSA Travel Insurance all rentals require a cleaning fee, 13% lodging tax, and a $55.00 non-refundable admin fee. Pet fees, pool fees and linen fees may also apply depending on your specific reservation.

Notice of cancellation or change must be received in witting by email or fax, at which time property dates will be placed as available online.

Cancellations or changes made more than 60 days before check-in are eligible for refund minus the non-refundable $55 administration fee and any Travel Insurance policy cost.

Cancellations or changes made less than 60 days before check-in are not eligible for refund.

No refunds will be issued for any reservation canceled within 60 days or less of the arrival date. There are no exceptions to the cancellation policy. We strongly recommend you protect your travel investment through the optional Travel Insurance

Vacation Rental Insurance has been made available with your reservation.  Travel insurance is non-refundable outside of the 10-day free look period after purchase.  If you have a preexisting reservation, Travel insurance may be added to your reservation up to the date your last payment is due or prior to departing for your trip, whichever occurs first.

Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. Eliminate the worry of additional expenses due to unintentional damage that may occur to the interior of your vacation rental home during your stay by choosing the $70 policy that provides up to $3,000 in protection against unintentional damage.

Vacation Rental Damage Protection Plan: As a part of your stay, you may purchase a $70 Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or actual cash value of such property up to a maximum benefit of $3,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy. The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Generali Global Assistance to pay directly Boardwalk Realty any amount payable under the terms and conditions of the Vacation Rental Damage. If you do not wish to purchase the Vacation Rental Damage Protection you may add $3,000 for a refundable damage deposit that will need to be mailed to Boardwalk Realty by check to secure your reservation. Unintentional damage does not cover smoking, unauthorized entry into owner’s closets, pet damages, excessive cleaning or intentional damage.  Any damage must be reported prior to your departure. Guest is responsible for any intentional damages as detailed above will be notified of damage and charges.  Guest authorizes Boardwalk Realty to charge non-covered damage costs to the credit card on file.

 

Refundable Deposit: If you do not wish to purchase the optional $70 Vacation Rental Damage Protection Plan, a refundable deposit equal to the $3,000 coverage protection is required to secure your reservation.

The $3,000 refundable damage deposit is to be paid by check, mailed to Boardwalk Realty and will be refunded by check 14 days after your departure, provided there are no damages.

Guests opting out of the Vacation Rental Damage Protection Plan agree to compensate the Property Owner for any damage to Property caused by Guests, invitees or visitors of Guests. In the event damage costs exceed Guests $3000 refundable deposit amount, Guest is responsible for any remaining balance. Guest assumes full responsibility for any items missing or damaged due to misuse, negligence or action on Guests or Guests visitors part, except in the case of normal wear and tear reported to Boardwalk Realty within 24 hours of check-in. Guest will be notified of any Damage costs and costs will be deducted from Guests deposit prior to the refund of any remaining deposit.

All properties are non-smoking, no exceptions. If smoking outdoors, Guest must not smoke near open doors or windows.  If there is evidence of smoking inside the property, Guest will be responsible for any damage and an additional cleaning fee will be charged to the credit card on file.  Guest must properly dispose of all cigarette butts prior to departure, if cigarette waste is evident, Guest will be charged an additional cleaning fee.

No pets are allowed in any property that is not advertised as pet friendly.  The presence of a pet (or evidence of a pet) in any non-pet friendly property is a violation of the Rental Agreement and may result in additional fees, possible forfeiture of the entire rent and immediate eviction.

Dogs are allowed, subject to some limitations, in homes noted as Pet Friendly. Pet Friendly refers to dogs only, cats and other types of animals are not allowed in any home.

Dauphin Island leash law must be followed, with dog on leash when out of doors.

Guests must notify Boardwalk Realty of dog(s) at the time of booking and complete the Dog Registration form prior to arrival.

A non-refundable fee applies per dog. Pet fee amount varies by property. In the event the online booking system does not apply the pet fee per/pet for multiple pets, Guest acknowledges that the non-refundable pet fee will be adjusted to reflect the correct fee for the total number of dogs.

Properties may have additional limitations on dog size, breeds allowed and the total number of dogs permitted.

Dogs must be current on all vaccinations.

Dogs must be on flea, tick and heartworm preventatives.

Dogs are not allowed on property furnishings.

Dog owners must properly bag and dispose of dog waste to keep the property yard, beach and shorelines sanitary for those walking with bare feet.

Should the property become unavailable prior to the Guests arrival for any reason beyond the control of Boardwalk Realty, including but not limited to sale of the property, Boardwalk Realty reserves the right to substitute comparable accommodations or cancel this Agreement and refund in full payments received from the Guest. When comparable accommodations are not available, Guest will have the option of selecting from available properties at the published rates or receiving a full refund of payments made by Guest.

Boardwalk Realty will not assume liability for any loss, damage or inconvenience caused by but not limited to: weather conditions, pandemics, natural disasters, pests, construction, utility outages, erosion, acts of God, or other reasons beyond Boardwalk Realty’s control. There shall be no refunds available as such instances are beyond the control of Boardwalk Realty and the Property Owner.  It is highly recommended that Guest considers travel insurance.

At check-in a maximum of two sets of property keys will be provided for your reserved Property. Keys should be returned to the Boardwalk Realty office at departure.

A $50.00 fee will be charged per lost key set, and collected at departure or charged to the Guest’s credit card on file. A $75 per gate card replacement fee will be collected at departure or charged to the Guest’s credit card on file for the loss of any Audubon Place gate card provided for Audubon Place rental properties.

All properties are privately owned. Decor, style, color, inventories and amenities reflect the tastes and preferences of the property owner and as such will vary from property to property. Furnishings and amenities are subject to change without notice. Every effort is made to accurately describe amenities with no misrepresentation intended. Substitutions and refunds will not be made upon arrival.

Please do not re-arrange the furniture or décor. Do not disconnect internet modems or TV and entertainment system cables. Do not set channel locks or PIN numbers on property TVs.

If renting multiple properties, no furnishings or kitchen items are to be moved from one property to another.

All properties are equipped with central heat and ac, furnished with dishes, basic cookware, coffee pot, toaster, microwave, dishwasher, ice maker or ice trays, washer and dryer, bed linens and bath towels. Grills are not guaranteed. For your convenience all properties are supplied with 1 roll of toilet tissue, small bar of soap per bathroom, small shampoo per bathroom, 1 roll of paper towels and 1 trash can liner in each trashcan. Guest is responsible for supplying additional paper products, soaps, spices, coffee filters, perishable items and beach towels and portable beach chairs for use outdoors.

Locked closets, locked storage rooms and locked cabinets are for Property Owner storage and are not available for Guest use or entry.

Guest understands and agrees to be responsible and liable for any damages that occur to the pool or spa and its support equipment through Guest misuse and/or negligence. Guest agrees to follow private and community pool rules and regulations. No refunds or adjustments will be made for pool/spa service outages.

If Guest requests available pool heater service, a pool heater fee will apply. Check your specific rental for details.

Guest agrees not to tamper with pool heat controls or manipulate pool heater in any way.

Pool technicians may enter the pool/spa area without notice for the purpose of maintenance and routine service.

Guests agrees to follow all posted pool rules and acknowledges that no diving is allowed at any pool/spa and Guest use of pool/spa is at your own risk.

Boardwalk Realty makes every effort to keep each Property and its equipment in good working order. In the case of a breakdown, we will strive to repair/replace equipment as soon as reasonably possible after we are notified of the problem.

No refund or adjustment will be made for the mechanical failure of items including, but not limited to - pool, pool heater, spa, jacuzzi, air conditioning/heating system, dishwasher, microwave, refrigerator, ice maker, washer/dryer, plumbing, water, sewer, electrical system, TV, VCR, DVD, cable receivers, wireless routers or other appliances or structural systems.

Guest agrees to notify Boardwalk Realty of mechanical failure, appliance failure or needed maintenance within a reasonable time after discovery so service appointments can be arranged and/or parts ordered in a timely fashion. Please do not wait until departure to notify Boardwalk Realty staff of a maintenance issue that was discovered earlier in your stay. Delaying reporting until departure may delay the repair for incoming guests.

Boardwalk Realty is not responsible for area utility, cable or Internet outages and no refund or adjustment will be made for utility, cable or Internet outages.

Guest agrees to allow Boardwalk Realty or its service provider the right to enter the premises at any time for the purpose of inspection and repair.

Internet service is available at all Boardwalk Realty properties; however, Island internet service, speed and signal strength may vary from location to location and can be affected by weather events and conditions outside of Boardwalk Realty’s control. If internet usage is required during your stay for work or school purposes, you may wish to bring a backup portable connection or hot spot.

The majority of rental properties do not provide landline phone service and Guests should bring their cell phones for calling. If the rental Property does provide local phone service, local calls made from the Property are free: however unauthorized long-distance charges will be billed to Guest along with a $20.00 fee.

Guest will reimburse Property Owner for any entertainment purchase made by Guest during Guest’s occupancy through cable, streaming or smart TV apps, including video rentals, pay per view, movies on demand, games or other entertainment services that allow purchases.

 

Due to our salt air environment, the presence or condition of outdoor grills cannot be guaranteed. If grill is present, use of outdoor grills on porches and decks is prohibited.

Re-locating a property or personal grill onto the property’s deck or wooden walkway may result in loss of deposit.

Grills must be operated at ground level, in a safe manner and monitored when in use.

Guest assumes all liability for grill use and is responsible for any property damage or injury resulting from grill use. Property Owners furnish grills at their discretion. Grills are not guaranteed to be present and no guarantee is made as to their working order.

Guest is responsible for properly disposing of any cooled charcoal and cleaning the grill after each use.

Bonfires/Beach fires are prohibited and are not allowed at any Boardwalk property.

Fireworks are prohibited by Town Ordinance and are not allowed at any Boardwalk property.

Due to insurance regulations electric cargo lifts and boat lifts are not available for use at any Boardwalk property.

 

The number of parking spaces available varies from property to property based on the driveway size, association rules, geographical features and occupancy limits. Please keep the number of vehicles to a minimum and contact Boardwalk Realty for parking information specific to your rental location. In general:

Boat trailers are not allowed to be parked in DeSoto Landing and Audubon Place gated communities or at some condominiums.

RV’s and motorhomes are not allowed to be parked in DeSoto Landing and Audubon Place gated communities. RV and motor home parking may be difficult in some west end court street driveways, please call for details prior to booking. RV and motorhome hookups are not allowed.

Motorized vehicles are not allowed on area beaches.

Vehicles must be parked in a driveway or in approved parking by permit location.

All driveways do not extend underneath homes, please check your surfaces before pulling underneath a property.

Please remain on paved, gravel or other driveway material surfaces. Vehicle wheels on sand will get stuck.  Guest is responsible for towing costs to remove vehicles from sand.

It is Guests responsibility to remain aware of and informed about the forecast weather in our area. As a low-lying coastal area our Island is subject to coastal flooding and impacts from storms and tides.

In the event of Tropical weather, if it is deemed necessary or if a mandatory evacuation is ordered by local agencies, Guest may be required to depart early or Guest arrival may be delayed. No refunds will be made for inclement weather.

Boardwalk Realty recommends Guests add CSA’s Travel Insurance Plan which covers the rent and reservation fees paid for the rental property you reserved. The insurance premium of 6.95% of your reservation is non-taxable and non-refundable.

Rental Property may be listed for sale and licensed sales agent may request a brief entry to the property for the purpose of: showing the property to prospective buyers; home inspection or appraisal.  Boardwalk Realty will make every effort to arrange any entry appointment with you in advance and at a time that minimizes disruption to your enjoyment of the property.

It is the responsibility of the Guest to leave the property in a reasonably tidy condition:

Household trash should be removed throughout your stay and placed in the outdoor container streetside for pick-up at the times scheduled for your location. Emptied cans should be returned to the property. Remove any remaining trash prior to your departure. Guest will incur a $50 per can disposal fee for more than half-full cans that were not placed streetside for pick up during your stay and must be emptied by Boardwalk staff.

Linens: please wash bath towels periodically during your stay and on the morning of your departure, leave used beds unmade and start a load of linens or towels in the washing machine.

Refrigerators and freezers should be emptied prior to departure.

It is the Guests responsibility to clean kitchen items and return them neatly to the kitchen cabinets after cooking. If there are any remaining soiled dishes on the morning of your departure, please load them in the dishwasher and start the clean cycle before departing.

It is the Guest’s responsibility to check the property interior (including drawers and closets) and the properties exterior (including decks) for personal items to ensure all of your belongings leave at the same time you do. Boardwalk Realty is not responsible for any personal belongings left at the property. Recovered lost and found items will be held for 15 days only. The shipping and handling fee to return recovered items will be charged to Guests credit card on file.

Close and lock all windows and doors upon exiting and return the keys (2 sets) to Boardwalk Realty.

Guests leaving Property in a condition that requires excessive cleaning time or additional cleaning staff members in addition to the norm to return the property to ready condition will be charged an additional cleaning fee.

Boardwalk Realty Inc is not responsible for injuries or accidents that may occur while Guest is occupying the said property.

Guest agrees to defend, indemnify and hold Boardwalk Realty and Property Owner harmless from any and all liability, claims, loss, property damage or expenses, arising by reason of any injury, death or damage sustained by any person, in or on the Property during the Term of this agreement, including Guest, family members, additional invitees or visitors of Guest. Guest agrees that Boardwalk Realty is not responsible for accidents or injury of any kind to Guest. Guest agrees that property owner is not responsible for accidents or injury of any kind to Guest. Guest agrees that Boardwalk Realty is not responsible for any damages to vehicles or personal Property of Guest. Guest agrees that property owner is not responsible for any damages to vehicles or personal Property of Guest.  Boardwalk Realty and Property Owner are not responsible for items left behind, lost or stolen.

Guest agrees to defend, indemnify and hold Boardwalk Realty and Property Owner harmless from any and all liability, claims, loss, property damage or expenses, arising by reason of any injury, death or damage sustained by any person, in or on the Property during the Term of this agreement, including Guest, family members, additional invitees or visitors of Guest. Guest agrees that Boardwalk Realty is not responsible for accidents or injury of any kind to Guest. Guest agrees that property owner is not responsible for accidents or injury of any kind to Guest. Guest agrees that Boardwalk Realty is not responsible for any damages to vehicles or personal Property of Guest. Guest agrees that property owner is not responsible for any damages to vehicles or personal Property of Guest.  Boardwalk Realty and Property Owner are not responsible for items left behind, lost or stolen.
